The Latin American Lawyer – Toledo Marchetti assists ABRAGEL in action at the STF

Toledo Marchetti Advogados was featured in the renowned magazine The Latin American Lawyer. The publication, entitled “Toledo Marchetti assists ABRAGEL in action before the Supreme Federal Court” highlights the performance of the firm in a case before the Supreme Federal Court, representing the Brazilian Association of Clean Energy Generation – ABRAGEL in the scope of the Direct Unconstitutionality Action 7319, which questioned the constitutionality of Law 11.865/2022 enacted by the State of Mato Grosso.

 

In an exceptional victory, the Supreme Federal Court upheld the action by an overwhelming majority of votes (8×2), recognizing the violation of the Union’s competence to legislate on water and energy, and to explore, directly or through authorization, concession or permission, the services and facilities of electric energy, and the energy use of watercourses. This decision establishes an extremely important precedent for the energy sector, emphasizing the need to respect the division of competences established in the Federal Constitution.
